James died between January and April 1840 in Martin Co; his will was written on 5 January 1840 and probated in Martin Co in April. In the will he named his wife, three sons, and daughters "Polly Whitley, Clary Harrison, Nancy Peal," and mentioned Warner G Bailey, and named three Bailey grandsons. Nancy died after 1850 in Martin Co; she was not found in the 1860 census as the head of her household. She and James had six children.
