- FROSTBURG — D. Nathan Porter, 75, Parkersburg Road, Eckhart, died yeslerday at Sacred Hearl Hospilal, Cumberland. Born at Eckhart, he was the son of the late Morris Porter and Mary Ann (Rephann) Porter. He had been a self-employed farmer and coal miner and was a member of Eckhart United Methodist Church. Surviving are his widow, Mrs. Mildred (Porter) Porter; one son, William Porter, Eckhart; three daughters, Mrs. Mina (sic: Nina) Pifalo, Mrs. Jane Pifalo, and Mrs. Shirley Robertson, all of Eckhart; two sisters Mrs. Virgie Stark here, Mrs. Emma Bloomer, Baltimore; two brothers, Russell Porter and Marshall Porter, both of Eckhart; four grandchildren and two great-grandchildren. Friends will be received at the Hafer-Sowers Funeral Home today from 2 to 4 and 7 to 9 p.m.

A dispute over a proposed memorial wall in the Eckhart Cemetery was heard yesterday afternoon in Allegany County Circuit Court by Associate Judge James S. Getty, who took the matter under advisement. The Eckhart Cemetery Committee filed an equity suit against Mrs. Jane Pifalo, seeking an injunction to prevent her from constructing the memorial to her father, Nathan Porter, who died about two months ago. The cemetery committee contends that there are regulations against placing any walls above the contour of the land. Testimony at yesterday's hearing indicated that the cemetery is actually owned by the Maryland Coal and Realty Company, which leases it to the self-perpetuating cemetery committee. The area has been a cemetery since 1861. Leslie J. Clark, attorney for the cemetery committee, called four witnesses. They included James Filsinger, committee secretary; Carl Blank, a committee member who said he has been digging graves there since 1948; F. Earl Kreitzburg and Mrs. Virginia Stephens, who own cemetery lots near the Porter lots where the memorial was planned. Gary G. Leasure, defense attorney, called only Mrs. Pifalo. She said that her grandmother, Mrs. Ida Porter, had purchased three lots in the cemetery 30 to 35 years ago. Her father, Nathan Porter, who died about two months ago, is buried in the cemetery. About three weeks after his death, Mrs. Pifalo said she decided to have a memorial constructed to her father. She said the plans call for it to be off-white bricks and no more than 18 inches above the ground. Mr. Blank had testified that the only walls in the cemetery are retaining walls to keep dirt from eroding from the cemtery into a roadway.
