    The family was living next door to Elizabeth Winters McKenzie, George Henry's mother.

    George Henry MCKENZIE was born in 1814. He died on 1 Aug 1872. Samuel Sampson McKenzie's parents were George Henry McKenzie (1814-Aug 1, 1872) son of Josua McKenzie and Elizabeth Winter and Susanna McKenzie (8 Mar 1815 - 19 Mar 1890) daughter of Samuel McKenzie and Rachel Durbin. (but I don't have death notices or obits to prove these. George and Susanna are both buried at St. Patrick'a Cemetery Cumberland. They are third cousins...I think.     Per the research of Ray Leidinger: "George MCKenzie and Susan of Samuel McKenzie - 10 November 1836" Allegany County, Maryland Courthouse.

    July 4, 1846 was married George McKenzie and Susanna McKenzie in presence of Jno. Byrne and Margaret Coffey. They were married invalidly years ago by a preacher. Today the third degree of consanguinity impeding, was dispensed and the marriage made good." Rev. L. Obermyer.

    In the name of God, Amen. I, George McKinzie, of Allegany County in the State of Maryland, being sick and weak in body, but of sound and disposing mind, memory and understanding, do make, ordayin, publish and declare this my last Will and testament in manner and form following, that is to say:
    First and principally, I commit my spirit to the keeping of its Merciful Author & my body to the earth to be decently buried at the discretion of my wife, and then I devise and bequeath as follows:

    1. To my dear wife, Susanna McKinzie I give and bequeath all my personal estate, subject to the payment of my debts and funeral expenses.

    2. To my said wife, Susannah McKinzie, I give and devise all my real estate, wheresoever situate, for and during her natural life and after the death of my said wife, I direct my Executors hereinafter named to sell and dispos of all my said real estate and thin[sic] I give and bequeath the proceeds arising from the sale of sales thereof as follows:

    3. To my daughter, Elizabeth, I give sixty dollars.

    4. To my daughter, Sarah Ann, I give sixty dollars.

    5. To my son, Enoch Ambrose, I give one hundred dollars.

    And the residue of such proceeds of sales of my real estate I direct shall be equally divided between all my childred, namely, John W., George H., Joshua F. Samuel S., Nicholas, Joanna, Susannah, Sarah A., Elizabeth, and Enoch A. share and share like[sic]. - Charging my son John W. with the sum of one hundred and fifty dollars and my son Joshua F with the sum of seventy-five dollars, money advanced to my said sons John W. and Josua F.

    And lastly, I hereby constitute and appoint Nicholas McKinzie and John B. Widener, Executors of this my last will and testament revoking and annulling former will by me heretofore made, ratifying and confirming this and none other to be my last will and testament

    Notes:

    Joshua McKenzie is referenced in Equity Case No. 734, Allegany County, Maryland Courthouse records as being the (deceased) brother of Moses McKenzie, Jr.

    His birthdate came from the genealogical archives of Col. G.T. MacKenzie (Ret.), who began his research in 1929. But per the research of Ray Leidinger, he writes: St. Patrick's Church, Cumberland, Maryland. :Joshua McKenzie died July 13, 1845, near Cresaptown, age 60." If he was 60 at the time of his death as reflected in this church record, it would mean his birth date was 1785 (not 1795), which would fit better with Elizabeth Winter's DOB. In a letter from Ray Leidinger to Michael A. McKenzie dated December 21, 2012.

    Joshua MCKENZIE and Elizabeth "Betsy" WINTERS were married on 14 May 1814 in Allegany Co., Maryland. Elizabeth "Betsy" WINTERS was born in 1786 in Maryland. She died in 1873 in Allegany Co., Maryland.

    At the request of Enoch McKenzie this deed was recorded October 11, 1873

    This deed made the 10th day of October in the year of our Lord one thousand eight hundred and seventy three by ELIZABETH McKenzie of Allegany County and State of Maryland of the one part and ENOCH McKenzie said County and the State of the other part. ?????? whereas the said Elizabeth McKenzie is ???? of dividing and conveying her real property amongst her two sons Enoch McKenzie the party of the second part to these presents and MOSES McKenzie, JUNIOR when the ??? condition to wit . That the said Enoch McKenzie shall within one year after the death of the said Elizabeth McKenzie pay to my son SOLOMON Robinson (my son by a previous husband) the sum of one hundred dollars in cash: and also when the farther condition that the said Enoch McKenzie shall also within one year from the date of the death of said Elizabeth McKenzie pay to the heirs of my deceased son George McKenzie sum of fifty dollar in conjunction with Moses McKenzie, Junior, who shall also pay the sum of fifty dollars to the heirs of my deceased son thus making together with the said sum of fifty dollars that Moses McKenzie shall pay the sum of one hundred dollars to be paid to the heirs of George McKenzie, deceased.     In the name of God, amen, I, Elizabeth McKinzie, of Allegany County in the State of Maryland, being weak in body, but of sound and disposing mind, memory and understanding considering the certainty of death and the uncertainty of the time thereof, do make, ordain, publish and declare this my last will and testament, in manner and form following, that is to say:

    First and principally, I commit my spirit to the Keeping of is's Merciful Author and my body to the earth to be decently buried at the discretion of my Executor hereinafter named.

    Secondly, It is my will and I hereby direct my said hereinafter named Executor to sell and dispose of all my real and personal property, wheresoever situate, at public or private sale as he may think best - to collect all debts due and owing to me at the time of my death and convert my whole estate into money - out of which I direct him to first pay my debts and funeral expenses and the residue thereof I give and bequeath as follows:

    1. To my son Solomon Robeson, I give four ninths of said residue of my estate, subject to a deduction for the sum of three hundred and fifty dollars with interest from the 22d day of March, 1859, being money I have paid for him.

    1. To my sons George McKinzie, Moses McKinzie, Enoch McKinzie and daughter Rosannah Carter each I give one ninth of said residue.

    3. To my sons Solomon robeson, George McKinzie, Moses McKinzie, Enoch McKinzie and daughters Rosannah Carter, Rhoda A. Morris, Susannah Wade and Ann M. Porter I give the other one ninth of said residue.

    And lastly, I hereby constitute & appoint my son George McKinzie to be sole Executor of this my last Will & testament, revoking and annulling all former wills by me heretofore made - ratifying and confirming this and none other to tbe my last Will and testament.     From the research of Ray Leidinger of Cumberland, Maryland:

    Sarah Ann McKenzie and Moses McKenzie, Jr. were married in Hampshire County, Virginia. Moses McKenzie, Jr. was a veteran of the Revolutionary War.

    From the notes of Philip Dietz, Jr. comes the following:

    Moses started as a drummer boy in Revolutionary War at age 18. He enlisted at Frederick Town and was discharged at Annapolis. He served in the Battle of White Plains 1776, the battle of Monmouth, and the siege of Yorktown. he was a member of the Maryland Line.

    From research conducted by Michael A. McKenzie in the Maryland Section of the Genealogical Section of the Atlanta Public Library on February 19, 1997, the following information was obtained:

    According to the Muster Rolls of Maryland Troops in the American Revolution (Baltimore Maryland Historical Society 1900), Moses served as a drummer in Lt. Col. Ludwig Weltner's German Battalion. He received a Federal Land Warrant on April 8, 1793 for 100 acres of land (that being Federal Warrant Number 11, 514) for his service in the Revolutionary War. Source: Revolutionary Records, Harry Wright Newman, Genealogical Publishing Company (1993)


    According to the Muster Rolls of Maryland Troops in the American Revolution (Baltimore Maryland Historical Society 1900), he was a new recruit on September 5, 1778 at White Plains. Another record shows the "date he was passed" that being April 28, 1778. All of the records also reflect that his brother, Joshua McKenzie was also in the same battalion and also served as a drummer boy. The same Muster Rolls also show that Moses was paid for his service for the months of July, August, September and October, 1779. The records further reflect that Moses and Joshua also served in Lt. Col. Weltner's battalion from 1 August 1780 until 15 November 1783. During that period of time the records reflect that they served as Privates.

    From the notes of Philip Dietz, Jr. comes the following:

    Moses also served in the "War with England - 1814", as a drummer in Capt. Blair's Company with Thomas Clinton, a fifer. Moses and Thomas had also served in the Revolutionary War. They lived in the Cumberland area, and on all public demonstrations were accustomed to come out on the street and play the fife and drum.

    From research conducted by Michael A. McKenzie in the Maryland Section of the Genealogical Section of the Atlanta Public Library on February 19, 1997, the following information was obtained:

    Contained in Maryland Records, Colonial, Revolutionary, County and Church from Original Sources by Gaius Marcus Brumbaugh, M.S., M.D., Volume II, Baltimore, Genealogical Publishing Co., Inc. 1985, the following appears:

    "McKinsey (sic), Moses. Passed Dec. session, 1815--No.23. Treas. Western Shore pay to Moses McKinsey, of Allegany County, -a sum of money, annually during life, quarterly, equal to half pay of a drummer in the rev. war."

    "McKinsey, Moses. Passed Mch. 9, 1827--No. 44. Treas. pay to Sarah McKinsey, of Allegany County, during life, half yearly, half pay of a private, for her husband, Moses McKinsey's services during the Rev. War."

    In April, 1818, Moses McKenzie, a resident of Allegany County, State of Maryland, applied for a pension by right of his services during the American Revolution. (10) He swore before the Circuit Court of that county that he was aged 58 years, and had enlisted at Frederick Town, Maryland in the German Regiment as a drummer boy - date of enlistment not given. He was assigned to the company of Captain Baltzell, and participated in the Battles of Monmouth and Yorktown.

    In 1820 he had in his immediate household who were dependent on him for support a wife aged 56 years, a daughter aged 16 years, a son aged 18 years and two grandsons aged 7.

    His pension ultimately was approved but he died on March 3, 1824.

    In October, 1841, his widow, Sarah McKenzie, of Cresaptown, Maryland, aged 76 years, applied for a widow’s pension by rights of her deceased husband’s service in the Revolutionary War.

    She the said Sarah McKenzie swore that she married Moses McKenzie sometime in the month of December, 1784.

    John Durbin of Knox County, Ohio, made an affidavit that he was present at the wedding which took place at the residence of Jacob Slagle in Hampshire County, Virginia, and that the ceremony was performed by a Catholic priest.

    Lucy McVicker, of Allegany County, Maryland, aged 69, submitted an affidavit stating that she was present at the marriage of Moses McKenzie and Sarah McKenzie, the latter also being named McKenzie.

    The claim of the widow, Sarah McKenzie, likewise was approved by the Commissioner of Pensions, Washington, D.C. (11)

    v.   Jesse McKenzie, born 1792 in Allegany Co.; died 1863; married Catherine Winters.

    In 1848 a Complaint was filed in the Court of Equity of Allegany County, Maryland by the brothers and sisters of Moses McKenzie, Jr., son of Moses McKenzie (b. 1760), requesting that a parcel of land (known as the “Western Road”) left by Moses, Jr. when he died intestate be equitably partitioned. This was the same parcel of land that was conveyed to Moses McKenzie (Moses McKenzie Jr.’s father) by Daniel Shriver, Jr. on September 13, 1812 and otherwise referred to in that deed as the “Western Road” property. The case lists all of Moses, Jr.’s brothers and sisters and their spouses and siblings where applicable. Jesse McKenzie is listed in the Complaint and received a share of the proceeds when the land was sold.

    Their Country's Call
    "Among the Civilian Soldiers who first took up arms in the time of
    emergency was a group of local volunteers who responded to the call of
    the Continental Congress on 7/14/1775. Along with Capt. Michael Cresap,
    1st Lt. Joseph Warren and 2nd Lt. Richard Davis, the volunteers from
    this area painted themselves to look like Indians and answered the call.
    They marched the 551 miles to Boston, Ma. in just 21 days, where they
    reported to General George Washington. The march began 7/18/1775 and
    ended 8/9/1775. The enlisted men who fought brilliantly under their
    able leaders included such men as Thomas Clinton, their fifer, ...Other
    volunteers included Moses McKenzie, William Roberts, William Davis, John
    Comp, William Taylor, George King, Daniel Recknor and James Byron.
    These men, as part of THE MARYLAND LINE, which gave the State its
    nickname, 'Old Line State', fought in the battle of Long Island in 1776.

    After the RW, Moses (b 1760) evidently came back to his father’s land in AA Co. He was ‘Moses of Moses, planter of AA Co.’ in 1783 when he sold 96 acres of McKinzie’s Discovery to James Cord.

    He evidently went to Allegany Co sometime after selling the AA land. He is found listed in Deakin’s Survey of 1787 as Moses McKinsy, Lot 3416. These folks supposedly were settlers Deakins found living on the land in 1787. If so, I don’t know where Moses was hiding between 1787 and 1797 because I don’t see him on any of the tax lists in Bobbie’s email.

    He was definitely in Allegany Co in 1792, however, when he served as Administrator for John’s estate.

    Per the genealogical research of Col. G.T. MacKenzie (Ret.), "moses Jr. came from Pennsylvania to Maryland circa 1799. He purchased lot 3416 in Allegany County 13 Dec 1795 and sold the same lot to Lawrence Speakman in 1798. He signed the deed as Moses of Bedford County, Pa and Sarah relinguished her dower rights.

    Col. MacKenzie further states:

    Moses Jr. (b. 1760) sold to Moses III (d. 1838) a farm called "Western Road (resurveyed) on the east side of Davis Mountain 20 Aug 1823. Book A Land Records of Allegany County, Maryland.

    P. 298 "The War With England 1814" says "Moses McKInsey and Thomas Clinton had both served in the Revolutionary War and were accustomed to come out on the streets of Cumberland, Maryand, where they lived, and play the drum and fife."

    My Father Ambrose R. McKenzie told Me,Joseph E.McKenzie,this story in
    July 1995. We were standing on Wills Creek AVE. in Cumberland,Maryland. Dad
    was looking down into the little creek just about 100 feet up from 307 Wills
    Creek AVE, Walter and Catherine McKenzie built this house in 1923,Dad told Me
    that His Father,Walter,was somewere in this area when He fell down the bank
    and injured Himself. Walter was ill from that day until He died. Dad said
    Walter died from LIVER problems and He always thought that it was because of
    that fall by the creek.
    From Leo Mckenzie, Son of Walter Mckenzie. Leo's recollection of the
    incident is "He Jumped across the stream with armfull of cucumbers".
    Walter E. McKenzie never drank whiskey in his life but made His living
    working in the distillery business.My Father told Me that Walter knew
    everything about distilling whiskey.
    On the same day Dad told Me about the little house just up the street
    305 Wills Creek Ave. from 307 Wills Creek AVE. on the other side. Dad said
    that during the Civil War it was a Mess hall and the Soldiers that were
    training at Campabella, this is Latin for "Camp of war" would eat at this
    house,log cabin at that time. Allegany High School now stands on Campabella,
    the School's nickname is the campers.
    From Leo Mckenzie, Son of Walter Mckenzie. Leo said "The mess hall was
    really the home of "Miss Miller's parents who sold pastry to soldiers when
    they were training,Shooting 58 Caliber rifles. The trench they laid in to fire
    their rifles was filled in to extend Allegany High around 1980"

    We have entered the forest of Rachels now, and the "Sale of Fountain Inn" saga. We researched this topic closely a few years ago, and need to bring Team MOEM up to speed slowly. Let me put it this way "We made a PowerPoint slideshow thst explains it".

    In a word, the sale of Fountain Inn was a key transaction that represented a financial watershed for the settler families of Federal Hill. In these transactions, they sold their interests in key coal lands (and access routes) to the Maryland Mining Co, which went bankrupt in pretty short order. Our ultimate take away was this: "our local clanfolk came out on the smart end of the deal". The Fountain Inn transaction foreshadowed other, larger deals that set up the era of "Big Coal" in our native lands - and benefited our ancestors well.

    So, not a short story, but one worth capturing at MOEM if we can tell it succinctly . . maybe maps will help :)

    30 May 1767 p.684 BB No 3 Rachael, widow of Moses, sold 32 acres of MacKenzie’s Discovery to John Cord, a blacksmith. (This would be her widow’s third.)

    There is no record of the inventory or administration of the estate of Moses so this sale was probably negated.

    26 Aug 1783 Moses of Moses sold all of McKenzie’s Discovery to James Cord
    Evidently Rachael is dead by then, but again no inventory or administration unless she married again and those records would be under another surname. Possibility that Moses was with her on the home place, as youngest or oldest. He did not marry until 1785. No Equity Case found so evidently other children of Moses of John d. 1758 did not protest sale.

This Joshua was son of Moses RW who was son of Moses 1720. Catherine Winters was the daughter of Geo Winter, perhaps the source of the name. Name Geo first appears in a chart by Samuel Doak Porter who shows Nicholas as son of Geo of Moses 1720. Actually Nicholas was son of Geo and Catherine and administered Geo’s estate.

    Suggest: Bennett, Jonathan, Joshua, Jesse and Moses all end up in Pa.Coincidence? Jonathan, Joshua, Jesse all end up in Ohio.

    With regard to the death date for Moses 1720, he was clearly dead long before 1779. I have Rachel Mckinsie listed as owing a debt to the estate of William Hall on 18 September 1771. I have Rachel selling Joshua into indenture in BA Co in 1768. And according to Bobbie, on 30 May 1767 AA Co Land Records P 684, BB No. 3 Rachel sold (unsuccessfully?) a portion of Mackenzie’s Discovery to James Cord. I don’t have this document. Have you ever seen it?

    Based on everything I’ve seen, I do believe Moses was dead by 1767.

    Thoughts from Ann McKenzie Stansbarger in an email to the author September 13, 2018:

    Hi Mike,

    The others will give you there own view on research objectives but I for one am thinking that Moses McKenzie became acquainted with the Porters because they had tenant farms near each other. This would answer the question about when and where the Mackenzies first met the Porters.

    My working hypothesis is that Moses was working a tenant farm prior to his father’s death. After his father’s death in ‘58, he had access to an additional 96 acres which was part of Mackenzie’s Discovery. I suspect there was no house on this plot, so Moses and the family may have continued to live on the tenant farm for a time. If the tenant farm was in AA, they could have worked the two farms easily.

    If the legend has a grain of truth in it, then Moses decided to sell his additions to the tenant farm (improvements, animals) and move on to a new stage in his life, either in AA, making due with 96 acres, or ultimately cashing out and moving west. That is when disaster struck and he died unexpectedly.

    My hypotheses is that he died on the road alone and his body was never found. The story of the murder is one that the Porters have preserved. I believe that is what Rachel thought.

    Anyway, it is a lot of conjecture on my part, but it makes sense to me. It would be nice to find something that would allow us to put this story to rest once and for all.

    Also it would be great if we could find a connection between the families within the enclave of tenant farmers on one of the Charles Carroll parcels.

    It’s exciting that Don Kagle was able to find this document (i.e. the letter from Rachel McKenzie to the administrator of Moses' estate). In the typed copy I got from a professional researcher the date was given as 1767. As I understand Testamentary Papers are the minutes of the Prerogative Court which functioned until the Revolution handling probate so Rachel’s letter would have been read at an early 1767 meeting of the Prerogative Court. We can probably shore up the date with the document, probably Orphans Court, that Ann Stansbarger found apprenticing Joshua age 3 or 4 .In May, 1767 Rachael, listed as widow of Moses, sold 32 acres (her widow’s third) of McKenzie’s Discovery to John Cord. p684 BB No 3 Anne Arundel Co.

    Thoughts from Scott Williams to the author. August 14, 2018:

    I will share with you the reader's digest version of one of my avenues of research. There are no original source records that positively link the Porters with the McKenzies before settlement in Western Maryland. If you believe tradition and family lore, they must have been in close proximity to each other in the generation of Daniel, Gabriel, and Daniel McKenzie down in the Patapsco/Baltimore Co/Frederick County area. We have reported intermarriage between Henry Porter and a Durbin as well as the reported Porter/McKenzie intermarriages. Yet no one (including the Colonel) has found proof in the traditional resources like deeds, patents, etc. We have a few other MD Porters thereabouts, but we have all but eliminated them as suspects. There are a ton of Porters along the PA/MD border, and they are not so easily eliminated, but they all seem to be Scots-Irish Protestants - again, not fully disqualifying, but not too promising either.

    This I do know (or propose as a thesis). The first positive connection in the record appears in Bedford County, PA. Sam and John McKenzie appear there in 1773, Gabriel and Sam in 1774 and again in 1775. John Porter appears on the next page from them in 1775 as a "renter". In 1776 Gabriel McKenzie and John Porter appear - and Sam appears as an "inmate" (uh-oh :)). The PA records appear to be non-existent for a few years then pick up again in 1779, when all I have is John Porter and no McKenzies. Do note, however that Gabriel, Aaron, Sam, and Daniel McKenzie take the loyalty oath over in Washington (now Allegany) County in 1778.

    So my thesis is that Gabriel and sons moved westward to Bedford County PA beginning in 1772 and that this move appears to coincide with the sale of three properties in Frederick County. Gabriel and sons stay on the Bedford side of the line until 1777 or 78 when they move across the line into Maryland. John Porter appears adjacent to them in the record from 1775 to 1778 when they move - he stays in PA until around 1784 and eventually resettles in Maryland. John Porter is reported to have lived near Wellersburg PA with is 'just across the line' from the Mount Savage area - and if you have been there, you will know that it is pretty much "all the same place".

    So, this puts John Porter in proximity to the McKenzies, but I need more in the way of kinship ties, etc. In the attached loyalty oath you will see all of our Catholic tribe in one place by 1778, including Henry Porter (brother of John and Moses Porter) who reportedly married a Durbin.

    On 5 NOV 1743, Gabriel McKenzie had a survey recorded for “Gabriel’s Choice”. (4) This tract lay southwest of Westminster MD, on the west side of Mt. Airy Road, between the tracts of James and Thomas Wells. The operative words of the document stated that the land was located in Baltimore County, which given the date is consistent with the fact that Frederick County (where the land is situated today) was formed from Baltimore County and Prince George’s County in 1748. It further states that Gabriel MacKenzie (actual spelling) had received a common warrant for 100 acres of land from “His Lordship’s Land Office dated the 17 Day of March, 1742 and that Gabriel was a resident of Ann Arundell County (actual spelling). (5) The land patent itself was formally issued on the “1st Day of December 1743 by Thomas Bladen, Your Lieutenant General and Chief Governor of our said Province of Maryland, Chancellor & Keeper of the Great Seal thereof.” (6)

    Per Thomas Scharf, Frederick County was not a safe place for Colonial settlers at the time Gabriel purchased and owned the property. (7) “In the French and Indian War which ensued after the Treaty of Aix-la-Chapelle in 1749, between England and France, Maryland became involved mainly in self-defense, and though she was to share none of its spoils, her people were destined to suffer from many of the dangers and hardships it brought in its train. Even before Braddock’s defeat bands of Indians were making forays into Frederick County burning houses and slaughtering the inhabitants, but after his disastrous overthrow on the 9th of July, 1755, and the retreat of Col. Dunbar with the remainder of the British Army to Philadelphia, the whole northern and western frontier of the province was thrown open to the Indians. Measures of defense were almost immediately adopted, but even had they sufficed for the complete protection of the wide territory to be guarded, they would scarcely have allayed the terror which had taken possession of the frontier settlers. The alarm inspired by Braddock’s defeat and by the advance of the French and Indians was so great that many inhabitants of the western settlements fled to Baltimore, and preparations were even made by the people of that town to place the women and children on board the vessels in the harbor and send them to Virginia”.

    In June 1750 Gabriel sued John White for cutting down the oak trees which marked the beginning of “Gabriel’s Choice.” (8)

    On 18 JUN 1754, Gabriel purchased 50 acres “Small Addition” from James (a later deed for the same property refers to the seller as John White) and Margaret White of Frederick County (Frederick County having been formed six years earlier in 1748) (9). The land was located in Frederick County and per the legal description was situated near the head of the Little Pipe Creek. The reference to “Little Pipe Creek” in both the patent for Gabriel’s Choice and in the deed for “Small Addition” suggests that the parcels may have been contiguous.

    On 14 JUL 1755, Gabriel McKenzie, planter of Frederick County, and his wife Sarah deeded to Nicholas Rodgers 200 acres, part of a “Resurvey of Gabriel’s Choice”.(10).

    On October 6, 1764, Gabriel MacKenzie of Frederick County secured a patent for 19 acres of land in Frederick County called Addition to Gabriel’s Choice. The recitations at the beginning of the deed/patent state as follows: “By virtue of a Warrant granted out of his Lordship’s Land Office of the Province to Daniel MacKenzie and John Logsdon of Ann Arundel County for seventy five acres of land bearing date 17th of January, 1764, which said warrant is assigned to Gabriel MacKenzie of Frederick County, etc.” Since Daniel McKenzie is not known to have had a child by the name of Gabriel, the only conclusion that can be drawn from the assignment of this patent is that Daniel McKenzie and John Logsdon were assigning a portion of their seventy five acres to Daniel’s brother, Gabriel. (10.5) The Logsdon connection is an interesting fact in view of the information set forth below that Gabriel’s wife also had a Durbin connection, since she was the daughter of Samuel Durbin and Anne (Logsdon) Durbin.

    On 28 Jun 1769, Gabriel McKinsey of Frederick County sold to William Buchanan 80 acres more or less of the property known as the “Resurvey of Gabriel’s Choice”. (11) The sale price was 66 Pounds. The deed reflects that the property consisted of a portion of the “Resurvey of Gabriel’s Choice” which was patented to Gabriel on the twenty third day of July, 1755. The deed further reflected that Sarah McKinsey, wife of Gabriel, had released her dower rights after having been examined out of the presence of her husband and did so “freely and voluntarily not being induced or compelled thereto by any threats of or ill usage from her said husband or fear of his displeasure.”

    Sarah McKenzie apparently was the first child of Samuel and Ann (Logsdon) Durbin. She was born September 19, 1724 in a log cabin near Westminister, Maryland. (12)

    On 7 APR 1772, Gabriel McKenzie sold three parcels of land in Frederick County totaling 147 acres to George Devilbess for the sum of 310 Pounds. (13) The three tracts included: (1) part of the original tract of “Gabriel’s Choice” and part of the “Resurvey of Gabriel’s Choice” (78 acres), (2) the “Small Addition” originally conveyed by John (sic) White to Gabriel in 1754 (50 acres) and which contains the reference to the “head of Little Pipe Creek” as referenced above and (3) a final tract entitled “Addition to Gabriel’s Choice”. Gabriel was listed as being a farmer residing in Frederick County, which coincides with the time line established by the Oath of Fidelity that Gabriel took in Washington County in 1778.

    On 6 AUG 1785 Gabriel MacKinzie of Washington County (13.1) sold to Henry Hoover a parcel of property located in Frederick County called “Mount Pleasant” containing 47 acres. (14) The legal description reflected that the beginning of metes and bounds description began at the end of the “fifteenth line of Gabriel’s Choice” and ran from that location. The deed reflected that Sarah once again relinquished her dower rights. One of the Justices of the Peace who acknowledged the deed was Andrew Bruce, who during the Revolutionary War, administered the Oath of Fidelity (15) (16) to Gabriel MacKenzie. The oath was administered on 2 MAR 1778 in Washington County, Maryland.

    On 25 April 1792, Gabriel McKinsey provided Leigh Master of Frederick County with a Release of Dower in connection with the previously discussed land transaction in June, 1769 between Gabriel and William Buchanan. Apparently, Sarah’s dower rights were not properly released at the time of the original transaction and the new owner wanted to obtain a clear title. The Release Deed reflected that Gabriel and Sarah were residents of Alleghany County, which is consistent with the fact that Alleghany County was carved from Washington County in 1789. The deed proves that both Gabriel and Sarah McKenzie were still alive as of April, 1792 and living in Alleghany County.

    One of the last known land transactions involving Gabriel McKenzie occurred in connection with a patent he received for land west of Fort Cumberland on which he had settled. In November 2010, Michael McKenzie of Mt. Savage, Maryland provided the author with a copy of the patent issued by the State of Maryland to Gabriel McKenzie. According to Michael, the patent was difficult to locate because the property actually was patented to Peter Mayors (Majors) on May 23, 1803, although the patent itself reflects that the property was surveyed for Gabriel McKinsey..(18) Per the documents, Gabriel appeared before the Honorable Andrew Bruce, one of the Justices of the Peace of Allegany County, Maryland on May 16, 1792 and conveyed the fifty acres of land comprising lot number 3365 to Peter Mayors (Majors). The lot was described as being in the “reserved land west of Fort Cumberland”. Then on May 17, 1803, another document signed by Thomas Harwood, Jr. acknowledged and swore that “Gabriel Mckinsey, a settler westward of Fort Cumberland paid the purchase money for lot 3365”. Yet another unsigned document associated with this entire group of documents states that “Gabriel McKinney settler on Lot 3365 assigned to Peter Mayors (Majors) Patent to Peter Majors the 23rd May 1803”. This last document is a little confusing in that it could be interpreted that Gabriel was still alive in 1803 and was once again acknowledging that he was assigning lot 3365 to Majors so that he could obtain his patent. Since it is assumed by researchers that Gabriel was born abt. 1715, he would have been 88 years old in 1803 if he was still alive and capable of assigning the property to Peter Majors.

    The same Michael McKenzie of Mt. Savage, Maryland has pinpointed the location of the Gabriel McKenzie land patent property. In these days of Google Maps, he did a fantastic job of locating the precise piece of property. Michael also provided the author with a copy of the 1874 Map of Military Lots, Tracts, Escheats, etc. in Garrett County and Allegany County, Maryland. That map is located in the Media Section of the McKenzies of Early Maryland website. (19) If you locate that map and look directly under the "i & n " in PENNSYLVANIA at the top of the page, you will see a triangular lot # 3365 just above “Bear Camp”. That is the 50 acres of land that comprised the Gabriel McKenzie land patent. If you compare the 1874 map with the current Google map, the same triangular piece of property appears. Michael McKenzie of Mt. Savage, Maryland wrote to the author in November, 2010 and advised: “the lot is still the same shape and is still 50 acres owned by a nice couple, Earl Lepley and his wife, who by the way is a descendant of Gabriel. She was blown away when I told her she is living on her Grandpappys property.”

    The author assumes Gabriel McKenzie died in Allegany County, Maryland after 1793 even though no will has ever been discovered, no any letters of administration, gravestone or church record.

    1. From this point forward, the author has drawn partially upon the research of Col. Gabriel Thornton MacKenzie, Ret. Colonel MacKenzie researched the McKenzie Family from the late 1920’s until his death in the early 1960’s. He compiled over 1800 pages of handwritten notes from his research and travels. His descendant Joseph Edward McKenzie, P.O. Box 1671, Dunedin, Florida 34697 reduced all of Colonel McKenzie’s notes to microfilm obtainable from Dataplex Corporation 1502-A Joh Avenue Baltimore, Maryland 21227. Col. MacKenzie began corresponding with McKenzie relatives in 1929. Those early letters from elderly relatives (several of whom were born in the mid-1800’s) contain a great deal of information on the early generations of McKenzies from Western Maryland.

    1.1 This information was gleaned from previous “research” of other McKenzie researchers. To date the author has not been able to find any documentation to substantiate it.

    2. The information pertaining to Samuel McKenzie was provided by Debbie Harper. It has not been verified by the author. Although he was listed as being a settler on the lands west of Fort Cumberland, Samuel never bothered to obtain a proper patent on the land. On 10 SEP 1814, he sold part of lot 3369 to William Logsdon, Sr.. Samuel McKenzie, Sr. died intestate in March, 1837. As part of the procedure for settling the estate, Samuel's sons, Samuel F.(Jr.), Gabriel and John applied for and received a patent for the two lots Samuel, Sr. was living on (lots 3369 and 3370). The patents can be located on the Maryland State Archives at MSA SE 1-1 Image 020745-0329 and also on the www.mckenziesofearlymaryland web site in the Media section. The document is cross-referenced with Samuel McKenzie (b. abt. 1751). The sons immediately sold these lots. The settlement papers for his estate list all of his children except for Catherine and Elizabeth, who died before him without issue. Nowhere in the estate papers is a living widow of Samuel, Sr. mentioned. Yet, she must have been living, for in 1839, she executed a "make good" deed conveying her interest in the lots to her son, Samuel. (In fact, the boys selling the lots without her signature was illegal. She had to issue a retroactive deed to her son, Samuel, in order to clear the title on the property.) The deed in part reads: "Then came Ellen McKenzie . . . who sells to her son, Samuel McKenzie . . . for the sum of $1.00 and the natural affection of a mother toward her son . . . lots 3369 and 3370". This clearly shows that Samuel F. McKenzie (Jr's) mother was Ellen ____( and not Rachel Durbin as claimed by some researchers). The "make good" deed from "Ellen McKinzey" to "Samuel McKinzey" is recorded at Deed Book "W", page 535, Allegany County records.

    Ed. Note: Given the similarity of names, the individuals who took the Oath of Fidelity to the State of Maryland most likely were Gabriel McKenzie and his sons, Samuel, Daniel and Aaron. Although the author does not have written proof that the individuals listed were father and sons, given the ages of Gabriel's children, the Oath of Fidelity information is consistent with Gabriel and his sons having migrated west to Washington County in the years preceding and/or during the Revolutionary War.
