Currituck County} To wit:
At an Inferior Court of Pleas and Quarter Sessions held at the Court House
in Currituck on the first Tuesday in December, Anno Domini 1768, present His
Majesty's Justices, the last will and testament of James Biggs, late of this
county, planter, deceased, the last will and testament of James Jenkins of
the same county, planter, deceased, having been then and there in open court
exhibited, proved and the respective executors or executrixes thereof
qualified in due form of law, the said wills were ordered to be recorded,
whereupon they here follow accordingly, that is to say, the last will and
testament of James Biggs in hea verba*:
In the name of God. Amen.
I, James Biggs, of Currituck County and in the Province of North Carolina,
being weak in body, but of perfect memory - thanks be to God for it -,
wherefore calling to mind the mortality of my body and knowing that it is
appointed for all men once to die, do make and ordain this my last will and
testament in manner and form following:
Imprimis, I give and bequeath to my well beloved son JOHN Biggs the
plantation whereon I now live and all the land belonging to it, to him and
his heirs, containing 200 acres.
Item, I give and bequeath to my well beloved son James Biggs fifty acres of
land joining his land and the Herring Run, to him and his heirs.
Item, I give and bequeath to my well beloved wife, BETHIA Biggs, one mare. I
also leave her the use of all the rest of my estate during her life or
widowhood, and then to be equally divided amongst the rest of my children:
ELIZABETH Leggett, ELEANOR Biggs, WILLIAM Biggs, ROBERT Biggs, CALEB Biggs,
Davis Biggs and AMARIAH Biggs, to be equally divided amongst them as was
mentioned before, and as for my two sons JOHN Biggs and James Biggs, to have
no part but what is mentioned to them. I likewise appoint my well beloved
wife, BITHA Biggs, to be my whole and sole executrix of this, my last will
and testament, utterly revoking, disallowing and disannulling all other
former will or wills by me heretofore willed, named or bequeathed, ratifying
and confirming this to be my last will and testament. In testimony whereof I
have hereunto set my hand and affixed my seal this 8th day of September,
1767.

Present His Majesty's Justices. The last will and testament of James Biggs,
late of this county, planter deceased, having been then and there in open
court exhibited and duly proved by the oaths of Rich. Fanshaw and William
Biggs, two of the subscribing witnesses, and the executrix therein appointed
duly qualified by the oath of an executor in due form of law, the will by
the order of the said Justices stands. Recorded as above.
